1. About these terms
1.1 These Terms and Conditions ("Terms") apply to your use of noticedsites.com and its related services: accounts, organisations, submissions, voting, collections, badges, the winner kit, the newsletter and featured directory listings (together, the "Service").
1.2 The following documents also form part of these Terms:
- the Acceptable Use, Community and Voting Policy
- the Badge and Brand Usage Terms
- the Featured Profiles Terms, where you buy a featured listing
- the Complaints and Takedown Policy
Our Privacy Policy and Cookie Policy explain how we use personal data.
1.3 By creating an account, submitting a website or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1.4 Consumers and businesses. Some clauses apply differently depending on whether you're a consumer (an individual acting mainly outside your trade, business, craft or profession) or a business user (including anyone acting for a studio, agency, organisation or client). Where we say so, a clause applies only to one or the other. Nothing in these Terms affects your statutory rights as a consumer.
2. Eligibility and accounts
2.1 You must be at least 16 years old to create an account.
2.2 Each person may hold one personal account. Accounts are personal and must not be shared, sold or transferred.
2.3 You sign in with your email address and a password of at least 10 characters. You must give accurate information and keep your password secure and not reuse it from other sites. Tell us straight away at support@noticedsites.com if you think your account has been misused.
2.4 Verified voter. When you verify your email address, your account becomes a Verified voter and can score websites. We may ask you to verify again, or remove voting ability, as described in the Voting Policy.
3. Organisations
3.1 A member can create an organisation (for example a studio or agency) and invite other people as owner, admin or member.
3.2 By creating an organisation or acting for one, you confirm you have authority to do so. The organisation's owner is responsible for who they add and what roles they give.
3.3 Any member of an organisation can submit websites and pay for them in the organisation's name, including with cards saved to the organisation. Only owners and admins can manage members, remove saved cards and buy or manage featured listings. Organisations are responsible for all activity by their members.
3.4 If an organisation is closed, or a member leaves, websites already published stay on Noticed under the organisation's name unless they're removed under these Terms.
4. Submissions: what you get for £9.99 (launch offer)
4.1 Price. Each submission of one website costs a flat £9.99 (GBP, launch offer price), shown before you pay. The launch offer price applies to submissions paid while it is shown on the site; any future price change will not affect submissions already paid for. No VAT is charged. There are no other discounts, promo codes or bundles. Discount codes: we may sometimes issue discount codes. A valid code reduces the price shown at the payment step before you pay; codes have no cash value, can't be combined, may have an expiry date or usage limit, and can be withdrawn at any time before they're used. A submission paid in full with a 100% discount code is treated the same as a paid submission. The no-refund terms in section 6 apply to the discounted amount you paid.
4.2 What the fee buys. Each paid submission includes:
- (a) publication of your website's listing on Noticed
- (b) a 72-hour public voting window that opens as soon as your submission is published
- (c) eligibility for every award that applies to it
- (d) continued public voting towards period awards
- (e) automated Google PageSpeed Insights measurements
- (f) badges and a winner kit for any award won
4.3 No guarantee of an award. Awards are decided by public votes and published thresholds. We don't promise any award, score, ranking, traffic or outcome.
4.4 Websites only. Submissions must be live, publicly accessible websites served over HTTPS. Apps, prototypes, design files and unfinished or placeholder pages aren't eligible.
4.5 Domain rule. The same registrable domain (for example example.com) can't be submitted again within 2 months (60 days) of its last submission.
4.6 Your promises (warranties). By submitting, you promise that:
- (a) you own the website, or have the owner's permission (including your client's) to submit it and to grant the licence in clause 7
- (b) the information, credits and screenshots are accurate and honestly show the submitted website
- (c) the website and your content don't break the law or the Acceptable Use Policy, and don't infringe anyone's rights
- (d) the website doesn't contain malware, phishing or harmful code
4.7 Automated checks and publication. Before you can pay, your submission must pass automated checks:
- completeness
- a profanity filter
- URL safety (including Google Safe Browsing / Web Risk)
- the domain rule
Once payment succeeds, we re-check URL safety. If it passes, your submission is published automatically and its 72-hour voting window opens immediately. Results from windows that closed on a given UK day are decided for Site of the Day at 08:00 UK the next morning. If it doesn't pass, we hold it for a short manual check and will tell you by email.
4.8 After publication. You can make limited edits (for example credits and description). Scores, votes and awards can't be edited.
5. Payment
5.1 Payments are taken by Stripe inside our website, using cards, Apple Pay, Google Pay or Link. We never see or store your full card number.
5.2 Organisations can save cards for future payments by members. Saved cards are only charged when a member actively confirms a payment. We never charge them automatically.
5.3 Your receipt is emailed and also available in your dashboard.
6. No refunds, and your cancellation rights
6.1 The £9.99 submission fee is non-refundable once payment has been taken. This applies whether or not your site wins any award, and also if your site is later removed for breaking these Terms or the Acceptable Use Policy, if it's disqualified for vote manipulation, or if you delete it or your account.
6.2 Why: every eligibility check runs before you pay, so a successful payment always results in a published listing with its voting window open, unless the post-payment safety re-check fails (clause 4.7).
6.3 Consumers: the right to cancel and immediate performance. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have 14 days to cancel a contract for services. Our service begins immediately after payment: we publish and schedule your submission straight away. Before you pay, we therefore ask you to tick a box confirming the following:
"I want Noticed Sites to publish and schedule my submission immediately. I understand that the service starts as soon as I pay, and that I will lose my right to cancel once the service has been fully performed. I understand the £9.99 fee is non-refundable."
We record the date and time you gave this consent and send a copy of it in your confirmation email. Where the service has started but isn't yet fully performed and you cancel within the cancellation period, you may have to pay for the service provided up to the point you tell us you're cancelling Because your listing is published and enters voting as soon as payment is confirmed, the service is normally fully performed at that point, so the right to cancel ends and no refund is due..
6.4 Mistakes on our side. If you're charged in error (for example, charged twice for the same submission because of a technical fault), contact support@noticedsites.com and we'll correct the error.
6.5 Your statutory rights. If you're a consumer, nothing in this clause affects your legal rights if the service isn't provided with reasonable care and skill, or as described.
6.6 Chargebacks. If you open a payment dispute while this clause applies, we may suspend the related listing while the dispute is open, and we may provide evidence to your card issuer.
7. Your content and the licence you give us
7.1 You keep ownership of your content: screenshots, videos, text, logos, profile information, collection notes and other material you upload ("Your Content").
7.2 Licence. You grant us a worldwide, non-exclusive, royalty-free, perpetual licence (which we can sublicense to our service providers) to host, store, reproduce, resize, crop, re-encode, display, publish and distribute Your Content, and to create derivatives such as thumbnails, share images and certificates. We use this licence to operate, promote and archive the Service, including on social media, in newsletters, stats pages, feeds, and in award announcements.
The licence continues for content connected to published awards and historic results, so the archive stays accurate. For other content, it ends when the content is removed, apart from reasonable back-up and archive copies.
7.3 Screenshots and third-party rights. We capture desktop and mobile screenshots of your submitted URL automatically when you submit; you can replace them with your own. Uploaded videos are re-encoded (WebM and MP4, up to 1080p, metadata removed) and only the optimised versions are published. You confirm that you have the right to upload the screenshots and media you submit, including any third-party material shown in them, and to grant this licence.
7.4 Feedback. If you send us suggestions, we can use them without any obligation to you.
8. Voting, scores and fraud
8.1 Verified voters can score published websites as described in the Acceptable Use, Community and Voting Policy. Scores are public.
8.2 We use automated systems to detect manipulation. Depending on what they find, we may reduce the weight of votes, automatically exclude suspicious votes from every score, revoke awards, disqualify submissions, or suspend accounts. Awards are selected from clean votes only and are not held for manual review.
8.3 Vote buying, vote exchanges, multiple accounts, bots and any other manipulation are prohibited. Disqualification for manipulation doesn't entitle you to a refund.
8.4 Our integrity decisions are made in good faith. You can appeal them through the Complaints and Takedown Policy.
9. Takedowns, suspension and termination
9.1 We may remove any submission, profile, collection, media or listing, revoke awards, badges and certificates, or suspend or close accounts, if we reasonably believe that:
- these Terms or our policies have been broken
- the law requires it
- the content is unsafe
- it's needed to protect users or the Service
Where it's appropriate and lawful, we'll tell you why and how to appeal.
9.2 Removed submission pages return a "gone" notice. Removing a site doesn't entitle you to a refund (clause 6).
9.3 You can delete your account at any time in Settings. See the Privacy Policy for what happens to your data.
10. Badges, certificates and the winner kit
Award badges, certificates and share images may only be shown for awards you've genuinely won and that haven't been revoked, and only in line with the Badge and Brand Usage Terms.
11. Featured profiles
Paid featured listings in the directory are governed by the Featured Profiles Terms. Featured listings never affect votes, scores, awards or rankings.
12. Collections, profiles and the newsletter
12.1 Public collections, public profiles and opt-in public voting profiles are visible to everyone. You control their visibility in Settings.
12.2 The newsletter is sent only if you opt in. You can unsubscribe at any time.
13. Our intellectual property
The Noticed Sites name, the N. mark, logos, badge designs, software, site design and compilation of content belong to us or our licensors. Except as these Terms allow, you mustn't copy, scrape at scale, or reuse them. Our stats datasets may be published under a separate open licence where we say so.
14. Availability and changes to the Service
We aim to keep the Service available, but we don't guarantee that it will be uninterrupted or error-free. We may change features, thresholds and rules for future voting windows. Where a change materially affects a paid submission that is already scheduled, we'll apply the rules that were in force when you paid.
15. Liability
15.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded by law.
15.2 Consumers. We're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We're not responsible for loss that isn't foreseeable. We only supply the Service for domestic and private use. If you use it for business purposes, clause 15.3 applies.
15.3 Business users. To the extent the law allows, we won't be liable for:
- loss of profits, revenue, business, goodwill, opportunity or data
- any indirect or consequential loss
Our total liability arising out of or in connection with these Terms in any 12-month period is limited to the greater of £100 or the total fees you paid us in that period.
15.4 We aren't responsible for third-party websites you visit through the Service, including submitted websites.
16. Indemnity (business users)
If you're a business user, you'll reimburse us for reasonable losses and costs resulting from third-party claims that Your Content, or your submission, infringes their rights or breaks the law.
17. Changes to these Terms
We may update these Terms. If a change is material, we'll give at least 14 days' notice by email or on the site before it takes effect, unless the change is required by law or for security. The version that applied when you paid for a submission continues to govern that submission.
18. General
18.1 If any part of these Terms is found unenforceable, the rest stays in force.
18.2 Not enforcing a right straight away doesn't mean we've waived it.
18.3 Nobody else has rights under these Terms (Contracts (Rights of Third Parties) Act 1999).
18.4 We may transfer our rights and obligations to someone who takes over the Service, and we'll tell you if we do.
19. Governing law and disputes
These Terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
Please contact us first at support@noticedsites.com. We'll try to resolve any complaint within 14 days.
